The Governing Board of the Indirect Taxation Authority of Bosnia and Herzegovina

The Governing Board (GB) of the Indirect Taxation Authority (ITA) was created under the Law on Indirect Taxation System in Bosnia and Herzegovina (BiH). The Governing Board is the body that oversees the ITA operation and is directly answerable to the Council of Ministers of Bosnia and Herzegovina.
The Governing Board is responsible for determining proposals for indirect tax policy, it defines strategic goals and approves the ITA annual plans of operation, ITA budget, bylaws and other implementing regulations prepared by the ITA.
The Governing Board has seven members with voting rights: Chairman, three Finance Ministers who are GB members ex officio and three indirect tax experts.
The observers to the GB are a representative of Brčko District, a representative of the Central Bank of Bosnia and Herzegovina and the ITA Director.
The Ministers are GB members during their term of office and other members have a five-year term with the possibility of a single re-appointment. In the event one of the members does not spend his/her full term, a new member is appointed for a period of five years in compliance with Article 17 of the Law on Indirect Taxation System.
The observers from the Brčko District and the Central Bank are appointed for a period of five years with the possibility of a single re-appointment.

Article 19 defines the method of GB voting, which provides that the GB shall vote by consensus. The Chairman’s duty is to announce whether consensus has been reached.

In the event consensus has not been reached, GB decisions are adopted in the following manner:

• In matters relating to the introduction of import and export duties and any changes in such duties, a majority of GB members’ votes are required, including the vote of the Minister of Finance and Treasury of Bosnia and Herzegovina.
• In matters relating to other indirect taxes, including the rates and structures of such taxes, the simple majority of GB members’ votes is required, including those of the Republic of Srpska and Federation Finance Ministers. This voting procedure also applies to any decision in relation to any exemption from or amendments to indirect tax rates and structure.
• In matters relating to the allocation of the indirect tax revenue, a simple majority of GB members’ votes is required, including the votes of all three Finance Ministers.
